Terms of Use

These Terms of Use (“Terms”) govern your access to and use of pillthegap, operated by PILLTHEGAP LTD (company number 16960393), registered office address 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (“we”, “us”, “our platform”). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms should be read together with our Privacy Policy and Cookies Policy.

1. Definitions and interpretation

1.1 In these Terms, the following definitions apply:

  • Account means the user account created to access the Service.
  • Account Owner means the individual who creates an Account and/or whose Payment Method is charged for Subscription Fees.
  • Content means all educational materials, practice questions, explanations, calculations, and other resources made available through the Service.
  • Device means a compatible mobile phone, tablet, computer, or other internet-enabled device used to access the Service.
  • Fees means the charges payable for a Subscription, as displayed at the time of purchase or renewal.
  • Payment Method means a valid and accepted payment instrument used to pay Fees.
  • Promotions means any special offers, discounts, trial periods, or promotional pricing made available at our discretion.
  • Service means the pillthegap platform, including all features, functionality, and Content accessible via the website or application.
  • Subscription means a paid membership plan that provides access to premium features and Content.
  • Third-Party Providers means external services integrated with pillthegap, including but not limited to Stripe (payment processing) and Supabase (authentication and database infrastructure).
  • User means any individual who accesses or uses the Service.

1.2 Headings are for convenience only and do not affect interpretation.

1.3 Words in the singular include the plural and vice versa.

2. About pillthegap

2.1 pillthegap is an online educational platform operated by PILLTHEGAP LTD, a company registered in the United Kingdom. The platform is designed to support pharmacy students, trainee pharmacists, and healthcare professionals preparing for the GPhC registration assessment.

2.2 The Service provides educational and revision content only. It does not provide medical, clinical, or professional advice, and use of the Service does not guarantee exam success.

3. Eligibility and age requirements

3.1 To use the Service, you must be aged 16 or over and you must use the Service for personal, educational, and non-commercial purposes only.

3.2 By creating an Account or using the Service, you confirm that you meet these requirements.

3.3 We do not knowingly permit use by individuals under the age of 16.

4. Account registration and access

4.1 Certain features require you to register an Account. You must provide a valid email address.

4.2 Authentication is provided via passwordless magic links. We do not store passwords.

4.3 You are responsible for maintaining the security of your Account and for all activity carried out using it.

5. Account responsibility and access control

5.1 The Account Owner is responsible for all activity associated with the Account, including where the Account is accessed by another person with the Account Owner’s permission.

5.2 You must keep control of Devices used to access the Service, safeguard access to your Account and payment details, and avoid sharing Account access with others.

5.3 You are responsible for keeping your Account information accurate and up to date.

5.4 We may suspend, restrict, terminate, or place an Account on hold where we reasonably believe this is necessary to protect you, the Service, or our Third-Party Providers from unauthorised access, identity misuse, or fraudulent activity.

6. Technical requirements

6.1 To access the Service, you must have a working internet connection and a compatible Device.

6.2 You are responsible for ensuring your equipment and connectivity are suitable for using the Service.

7. Subscriptions and payments

7.1 pillthegap offers both free and paid subscription plans.

7.2 Your Subscription will continue until cancelled or terminated in accordance with these Terms.

7.3 To access paid features, you must have a valid Payment Method. By subscribing, you authorise PILLTHEGAP LTD to charge the applicable Fees to your Payment Method via Stripe. Charges are billed in advance on the billing date shown in your user profile.

7.4 Unless you cancel before your billing date, you authorise us to charge the Fees for the next billing cycle.

7.5 Your payment date may change in certain situations, including where a payment does not successfully settle, you change your Subscription plan, or your paid membership began on a calendar day that does not occur every month.

7.6 You remain responsible for any Fees that are not successfully collected. If a payment fails due to expiry, insufficient funds, or other reasons, and you do not cancel your Subscription, we may retry the charge or suspend access to paid features until a valid Payment Method is successfully charged.

7.7 All prices displayed on the Service are inclusive of VAT for customers in the United Kingdom. Some payment methods may incur additional charges imposed by the payment provider, such as foreign transaction or processing fees. These charges are outside our control and remain your responsibility.

7.8 You may cancel your Subscription at any time by going to your user profile, selecting “Manage subscription”, and completing cancellation via the Stripe payment dashboard. After cancellation, access to paid features continues until the end of the current billing period and no further charges will be made.

7.9 To the extent permitted by law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or incomplete use of Content.

7.10 We may offer Promotions from time to time. We reserve the right to determine eligibility for Promotions, withdraw or revoke offers at any time, and place an Account on hold if we reasonably believe a User is not eligible.

7.11 We may update Subscription plans, features, or pricing from time to time. Any changes will take effect no earlier than 30 days after we notify you and will apply only to future billing cycles.

8. Use of the Service and access rights

8.1 Access to the Service and all Subscription Content is provided solely for your personal, educational, and non-commercial use.

8.2 You must not share your Account or allow non-subscribers to access paid Content.

8.3 For the duration of an active Subscription, we grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Service in accordance with these Terms. No ownership rights are transferred.

9. Acceptable use and prohibited activities

9.1 You agree to use the Service in compliance with all applicable laws and regulations.

9.2 Except where expressly permitted, you must not copy, reproduce, distribute, modify, publish, sell, or otherwise exploit any Content obtained through the Service.

9.3 You must not:

  • (a) bypass, disable, interfere with, or undermine security or content protection measures;
  • (b) use bots, scrapers, spiders, scripts, or other automated tools to access or interact with the Service;
  • (c) reverse engineer, decompile, or disassemble platform software;
  • (d) insert code, manipulate Content, or disrupt platform functionality;
  • (e) collect or extract data using data mining or harvesting techniques; or
  • (f) upload, transmit, or distribute malware or harmful code.

9.4 We may suspend, restrict, or terminate access where we reasonably believe these Terms have been breached or where use of the Service is unlawful or harmful.

10. Educational, clinical, and GPhC disclaimer

10.1 The Service is an exam preparation platform. Content, scenarios, and calculations are simplified for assessment and revision purposes and may not reflect real-world clinical complexity, patient variability, or professional practice. The Service and Content must not be relied upon for real-world clinical decision-making.

10.2 pillthegap is an independent service and is not affiliated with, associated with, authorised by, or endorsed by the General Pharmaceutical Council (GPhC) or any other regulatory or professional body. References to the GPhC are for contextual and descriptive purposes only.

10.3 You acknowledge that the Service is intended solely for educational and revision purposes and must not be used as a reference for patient care, prescribing decisions, or any form of clinical practice.

10.4 You are solely responsible for independently verifying all drug doses, pharmaceutical calculations, and clinical information against authoritative and up-to-date sources, such as the British National Formulary (BNF) and NICE guidelines, before applying any knowledge in a professional or clinical setting.

10.5 Although we endeavour to maintain Content that aligns with current GPhC standards and pharmacy practice, regulatory guidance and clinical recommendations are subject to frequent revision. We do not guarantee that all Content reflects the most recent regulatory updates at the time you access the Service.

11. Examination booking responsibility

11.1 We do not book, register, or administer examinations on your behalf.

11.2 You are solely responsible for registering for any examinations, meeting deadlines, and complying with the requirements of any professional body or examination board.

12. Intellectual property

12.1 All Content, software, branding, and materials on the Service are owned by or licensed to PILLTHEGAP LTD and are protected by intellectual property laws. All rights not expressly granted are reserved.

12.2 The pillthegap name, logo, and associated branding are proprietary trademarks of PILLTHEGAP LTD. You must not use, reproduce, display, or distribute our name, logo, or branding elements without prior written consent.

13. Unsolicited submissions

13.1 We do not accept unsolicited ideas, suggestions, or materials relating to the Service, Content, features, or development.

13.2 Any unsolicited submissions will not be treated as confidential, and we are not responsible for similarities between such submissions and existing or future platform content or functionality.

14. Third-Party Providers

14.1 The Service relies on Third-Party Providers, including Supabase for authentication and database infrastructure and Stripe for payment processing.

14.2 The Service may include links to third-party websites. We are not responsible for their content, availability, or practices.

15. Cookies

15.1 The Service uses necessary cookies only to support essential functionality such as secure login and session management.

15.2 We do not use cookies for advertising.

16. Electronic communications

16.1 You agree that we may communicate with you electronically regarding your Account, including billing notices, invoices, payment authorisations, security messages, and updates to these Terms.

16.2 Communications will be sent to the email address provided during registration. You are responsible for keeping your contact details up to date.

17. Data protection and GDPR rights

17.1 We process personal data in accordance with applicable data protection laws, including UK GDPR.

17.2 Subject to legal requirements, you have the right to access your personal data, request correction or deletion, restrict or object to processing, and request data portability.

18. Marketing communications

18.1 You may unsubscribe from non-essential marketing emails at any time by clicking the unsubscribe link in our emails or by contacting hello@pillthegap.com.

18.2 Service-related communications (such as billing or security messages) will continue where necessary.

19. Warranties and limitation of liability

19.1 The Service is provided on an “as available” and “as is” basis. We do not guarantee uninterrupted or error-free operation.

19.2 Continuous availability of the Service is not guaranteed, and periods of scheduled maintenance may be necessary. You are advised not to depend solely on pillthegap for revision immediately before important examination or assessment deadlines. PILLTHEGAP LTD shall not be held liable for any disruption to your study or revision plans arising from periods of technical unavailability.

19.3 To the fullest extent permitted by law, we exclude all warranties not expressly stated in these Terms.

19.4 PILLTHEGAP LTD is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses arising from your use of or inability to use the Service.

19.5 To the extent permitted by law, the total liability of PILLTHEGAP LTD for any claims arising from or relating to these Terms or the Service shall not exceed the total amount of Fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim, or £100, whichever is greater.

19.6 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015 where applicable.

19.7 If you are a consumer, you have legal rights in relation to services that are faulty or not as described. Nothing in these Terms affects those statutory rights.

20. Indemnification

20.1 You agree to indemnify and hold harmless PILLTHEGAP LTD, its directors, officers, employees, and agents against any claims, damages, losses, liabilities, or expenses (including reasonable legal costs) arising from or in connection with your breach of these Terms, your misuse of the Service, or your violation of any applicable law or regulation.

20.2 This indemnity does not affect any statutory rights you may have as a consumer under applicable law.

21. Suspension, termination, and enforcement

21.1 We may suspend, restrict, or terminate your access to the Service where we reasonably believe these Terms have been breached, or where continued use poses a risk to you, other Users, the Service, or our Third-Party Providers.

21.2 You may stop using the Service at any time.

21.3 If your Account is suspended, you may lose access to the Service and Content, including any saved progress, practice history, and performance data.

21.4 If your Account is suspended due to breach of these Terms, billing will not be paused or refunded. If suspension results from a billing issue (such as a failed payment), you may regain access by updating your Payment Method and settling any outstanding Fees.

21.5 Following suspension, access may be restored at our sole discretion, and we may require you to confirm compliance with these Terms or take corrective action before restoring access.

21.6 If your Account is terminated, all rights granted to you under these Terms will immediately cease.

21.7 Sections relating to intellectual property, limitation of liability, governing law, and any other provisions that by their nature should survive will remain in effect after termination.

22. Changes to these Terms and assignment

22.1 We may update these Terms from time to time.

22.2 Where changes materially affect your rights or obligations, we will provide at least 30 days' notice before they take effect. Continued use of the Service constitutes acceptance of the updated Terms.

22.3 We may transfer or assign our rights and obligations under these Terms as part of a business reorganisation, sale, or transfer, provided this does not reduce your statutory rights.

23. Governing law

23.1 These Terms are governed by the laws of England and Wales.

23.2 Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

23.3 Prior to initiating any formal legal action against PILLTHEGAP LTD, you agree to first attempt informal resolution by contacting us at hello@pillthegap.com. We will endeavour to address and resolve the matter through email correspondence.

23.4 Should the dispute remain unresolved after 30 days from your initial contact, either party may proceed with formal legal action in accordance with clause 23.2.

24. Class action waiver (where permitted by law)

24.1 Where permitted by law, you and PILLTHEGAP LTD agree that disputes must be brought only on an individual basis and not as part of any class, collective, or representative proceeding.

24.2 This clause does not apply where prohibited by law.

25. Force majeure

25.1 PILLTHEGAP LTD shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, pandemics, acts of government, war, terrorism, civil unrest, power outages, internet or telecommunications failures, cyberattacks, and failures or outages of Third-Party Providers.

25.2 In such circumstances, our obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume the Service as soon as practicable.

25.3 No refunds or credits will be issued for interruptions caused by force majeure events.

26. Severability

26.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

26.2 If modification is not possible, the provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

27. Entire agreement

27.1 These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and PILLTHEGAP LTD regarding your use of the Service and supersede all prior or contemporaneous communications, proposals, understandings, and agreements relating to the subject matter.

27.2 No statement, promise, or representation made by any representative of PILLTHEGAP LTD (whether via email, social media, customer support, or otherwise) shall form part of this agreement unless expressly incorporated into these Terms.
